*Chesterfield Tidy Tiling Terms and Conditions

 

****1. Scope of Work**

Chesterfield Tidy Tiling ("the Company") provides professional tiling services including floor, wall, bathroom, and outdoor tiling. The specific scope of work for each project is dependent on the unique requirements and preferences of the customer. Prior to commencement of work, a detailed discussion will be held with the customer to determine the specific scope of work, including materials, design considerations, and any additional services required. This ensures that the customer's expectations are fully understood and met throughout the project.

 

**2. Acceptance of Terms**By engaging Chesterfield Tidy Tiling for services, the client acknowledges and agrees to abide by these terms and conditions.

 

**3. Payment Terms**

3.1 Payment is due upon completion of the work, unless otherwise agreed upon in writing. The client agrees to make prompt payment for all services rendered by Chesterfield Tidy Tiling, in accordance with the terms outlined in the invoice provided upon completion of the project.

 

3.2 Late Payment Penalties:

    •    Payments not received within 7 days of the due date specified on the invoice will incur:

    1.    A late payment fee of £75 or 5% of the outstanding balance, whichever is greater.

    2.    Interest at a rate of 8% above the Bank of England base rate, calculated daily from the due date until the balance is fully settled.

    3.    If the balance remains unpaid, an additional late fee of £75 or 5% of the outstanding balance (whichever is greater) will be applied weekly.

 

3.3 Grace Period and Escalation:

    •    If the balance remains unpaid for more than 14 days, Chesterfield Tidy Tiling reserves the right to escalate the matter to a collections agency or initiate legal proceedings. All associated costs, including legal fees and collection charges, will be added to the outstanding balance.

 

3.4 Payment Methods:

    •    All payments shall be made in GBP and sent to the Service Provider’s designated bank account, as specified by the Service Provider. Payment methods accepted include cash, cheque, or electronic transfer. Any fees associated with electronic transfers shall be borne by the client.

 

3.5 Invoice Disputes:

    •    Invoices not disputed within 14 days of receipt will be considered accepted by the client, and any subsequent disputes will not affect the client’s obligation to make payment in accordance with the agreed terms.

 

3.6 Credit Card Payments:

    •    Payments made by credit card may be subject to additional processing fees, which will be clearly communicated to the client before payment is processed.

 

**4. Cancellation Policy**

    1.    Customer-Initiated Cancellations

    •    If a project is canceled by the customer less than 7 days before the agreed start date, a cancellation fee will apply.

    •    The cancellation fee will consist of:

    •    100% of the cost of materials already purchased or specifically ordered for the project.

    •    Up to 50% of the agreed labor cost, depending on the amount of notice provided.

    2.    Materials

    •    If materials have been purchased before the cancellation, the customer is responsible for covering their full cost.

    •    These materials will be retained by Chesterfield Tidy Tiling unless delivery to the customer is requested however a delivery fee of 5-10% will apply of the material costs.

    3.    Labor Costs

    •    Labor costs charged as part of the cancellation fee are intended to cover lost time and scheduling impacts.

    4.    Exceptions

    •    If the cancellation is due to exceptional circumstances, such as unforeseen emergencies, Chesterfield Tidy Tiling may waive or adjust fees at its discretion.

    5.    Payment of Fees

    •    Cancellation fees are due within 7 days of the cancellation date and will be invoiced accordingly.

.**5. Materials and Warranty**The Company will utilize high-quality materials in all projects. We offer a 12-month guarantee on our workmanship.

 

**6. Liability and Insurance**The Company holds appropriate insurance coverage and is liable for damages to property or injuries that occur during the tiling process.

 

**7. Debt Collection by a Third Party**In the event of non-payment by the Client for any outstanding amounts past 14 days after the due date, the Service Provider may assign the debt to Equilibrium Debt Recovery Limited, Company Registration Number 13437333, to pursue collection on its behalf. The Client shall be responsible for any costs or fees incurred by the Service Provider for the debt collection services, including but not limited to Council fees and collection agency fees.

 

**8. Completion Timeline**An estimated timeline for project completion will be provided, with allowances for unforeseen circumstances such as extreme weather conditions, material availability delays, or unforeseen site conditions. The Company will make reasonable efforts to notify clients of any delays and provide updated timelines accordingly.

 

**9. Changes and Additional Work**Any changes to the scope of work must be agreed upon in writing by both parties. Changes may result in additional costs and time extensions, which will be communicated to the client in advance. The Company will provide a written change order detailing the modifications and associated costs for the client's approval before proceeding with the work.

 

**10. Customer Reviews and Testimonials**Chesterfield Tidy Tiling values feedback from our clients and strives to continuously improve our services. With the client's consent, we may request feedback and testimonials upon completion of the project to showcase our work and service quality to future clients. Client testimonials and reviews may be used for marketing and promotional purposes, including but not limited to website content, social media posts, and printed materials. Clients who provide testimonials or reviews may request anonymity or opt-out of having their feedback shared publicly. Chesterfield Tidy Tiling respects the privacy preferences of our clients and will honour any such requests promptly.

 

**11. Waste Disposal**Unless otherwise agreed upon in writing prior to the commencement of the project, the client is responsible for the disposal of any waste materials generated during the tiling process. This includes but is not limited to old tiles, grout, adhesive, and packaging materials. The client agrees to ensure proper disposal of waste materials in accordance with local regulations and environmental guidelines. Failure to do so may result in additional fees or penalties imposed by local authorities. If the client wishes to delegate waste disposal responsibilities to Chesterfield Tidy Tiling, it must be discussed and agreed upon in writing prior to the start of the project. Additional charges may apply for waste disposal services provided by the Company. The Company shall not be liable for any costs, damages, or liabilities arising from the client's failure to properly dispose of waste materials in compliance with applicable laws and regulations.

 

**12. Client Responsibilities**Clients are responsible for providing access to the work area and making decisions regarding tile placement and design.

 

**13. Compliance with Regulations**The Company will ensure compliance with all relevant building codes and regulations.

 

**14. Termination of Agreement**Either party may terminate the agreement in writing, with notice provided in accordance with local laws and regulations. In the event of termination, the client shall be responsible for any outstanding payments for completed work or expenses incurred by the Company up to the termination date.

 

**15. Subcontractors**If the Company employs subcontractors to assist with the tiling project, it will ensure that they meet the same standards of professionalism and quality as the Company itself.

 

**16. Client Satisfaction**The Company values client satisfaction and encourages open communication throughout the project. Clients are requested to promptly communicate any concerns or issues regarding the completed work within 14 days of project completion. The Company will make reasonable efforts to address and resolve any concerns in a timely manner.

 

**17. Intellectual Property**The Company retains ownership of any designs, plans, or other intellectual property created during the course of the project.

 

**18. Force Majeure**The Company is not liable for delays or failure to perform due to circumstances beyond its control, such as acts of nature, government actions, or supplier shortages.

 

**19. Confidentiality**Both parties agree to keep any confidential information shared during the course of the project confidential and not to disclose it to third parties without prior written consent, unless required by law. Confidential information includes but is not limited to project details, financial information, and trade secrets.

 

**20. Governing Law**This agreement shall be governed by and construed in accordance with the laws of The United Kingdom, and any disputes shall be subject to the exclusive jurisdiction of the courts of The United Kingdom.

 

**21. Indemnification**The client agrees to indemnify and hold Chesterfield Tidy Tiling harmless from any claims, damages, or liabilities arising out of or related to the client's breach of these terms and conditions, negligence, or failure to comply with local building regulations. This includes but is not limited to claims related to property damage, personal injury, or disputes with subcontractors.

 

**22. Sever ability**If any provision of these terms and conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

 

**23. Right to Walk Away**Chesterfield Tidy Tiling reserves the right to terminate the agreement and walk away from the job if the client fails to adhere to the terms and conditions outlined herein, or if unforeseen circumstances arise that prevent the Company from completing the work in a satisfactory manner.

 

**24. Additional Costs**While every effort will be made to provide an accurate estimate for the project, the client acknowledges that unforeseen circumstances or changes in the scope of work may result in additional costs. The Company will promptly notify the client of any additional costs incurred and obtain approval before proceeding with the work.
